How the Process Agent Service Works
Evilsizor Process Servers Inc is the third party blanket company which acts as a messenger of legal documents, received for our FMCSA subscribers only. As a subscriber, Evilsizor will agree to accept legal documents (regarding transportation related cases only) as prescribed in the Code of Federal Regulations Part 1044 then we will forward those documents on to you, our subscriber, in a timely manner either by fax, email and/or mail.
All summons, other court documents and/or DOT letters received on your behalf are mailed to you via Priority Mail with Signature Confirmation to the address listed on the FMCSA/USDOT systems. It is your responsibility to be sure the FMCSA/USDOT systems reflect the most up to date contact information such as mailing address and phone numbers.
We will not accept any divorce papers or any other personal court documents that is not related to the interstate transportation industry.
Scope of Services
Evilsizor Process Servers, Inc only accepts Service of Process in its role as a BOC-3 service provider. Evilsizor has designated agents for this purpose in all 50 states + Washington DC. Evilsizor's designated agents can not be used by its clients for their own purposes. For instance, clients are not authorized to designate Evilsizor's agent in the client's home state as their corporate Registered Agent for Service of Process with the home state secretary of state. Evilsizor's role is strictly limited to accepting legal documents as BOC-3 service provider only, and for no other purpose. Evilsizor does not assist motor carriers and any other transportation related company with designating registered corporate agents or any agents beyond the scope of BOC-3 services.
Service Fee if service has been initiated
We reserve the right to charge a service fee of $99 for EACH service received on your behalf. Services may include but not limited to, court documents, summons, default judgments and DOT letters. You have 30 days from the date of the invoice to make your payment. The BOC will be removed from your Motor Carrier/Broker account if not paid on day 31 and we will no longer serve any further documents on your behalf. Please be advised the removal of your BOC-3 filing may cause your authority to go inactive with the FMCSA.
If the invoice is not paid by day 45 the invoice will be sent to American Profit Recovery for collections.
BOC Expiration
The BOC-3 expires June 30th of every year. Visit https://www.evilsizor.co/boc-annual-renewal.html to submit your renewal. It may also be removed by Evilsizor Process Servers Inc by the notice in Termination of Service [see below]. Please be advised removal of the BOC may result in loss of your authority.
Payment
All payments for process agent services are due upon receipt. If a payment is not received or payment method is declined, then your request for BOC-3 filing will not be granted. If you initiate a credit card dispute it will be removed immediately which may result in inactivation of your authority from the FMCSA.
Filing Policies
All BOC-3 filings are final. A new BOC-3 is required for a new application, address change, reinstatement, name change and/or transfer of authority and subject to an annual filing.
Refund Policy & Cancellation
All BOC-3 sales are final. A BOC-3 order may be cancelled up until payment has been processed. Once payment has been processed, the purchaser is responsible for the payment. There will be no refunds issued for cancellations after Evilsizor emails the Customer confirmation of the completed filing.
Chargebacks
Customer agrees that no "chargebacks" will be issued prior to making contact with us to settle any disputes. We require written agreement to perform a "chargeback". If a chargeback is issued without prior written agreement, the customer will be subject to reimburse us for all fees incurred during the dispute process. We reserve the right to pursue legal action if necessary to recover any fees owed. If a chargeback is approved, the amount will be credited back to the original payment method used for the purchase. Please allow up to 10 business days for the chargeback to be processed and for the funds to appear in your account. If you have any disputes or concerns about your purchase, please contact us before issuing a chargeback. We are committed to resolving any issues and ensuring that you are satisfied with your purchase.
For Agent Only - Dispute Policy
If you are an agent filing a BOC on your clients behalf and the client disputes the credit card charge. You are responsible for a $99 fee to cover the BOC and bank dispute fees. You will be invoiced separately. The BOC will be removed from the system immediately. Once the invoice is paid we will promptly refile the BOC.
Indemnification
You agree to indemnify, defend and hold harmless Evilsizor Process Servers Inc, its affiliates, successors, joint venturers, partners, officers, directors, employees, agents, licensors, suppliers and any third party information and/or service providers to the Service from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement (including but not limited to negligent or wrongful conduct) by you or any other person accessing the service.
We do not provide any legal advice. You will need to seek appropriate legal representation on your own, if applicable.
Termination of Service
Evilsizor Process Servers Inc reserves the right to cancel & remove the BOC from the FMCSA record under these circumstances:

Termination of Service

- Disputed credit card charge
- Non-payment of invoice for process service
- Non-payment of annual fee by 6/30 each year
- At the discretion of Evilsizor Process Servers Inc in unusual circumstances outside of normal business practice
