How the Process Agent Service Works
Evilsizor Process Servers, Inc. is a third-party blanket company that acts solely as a messenger for legal documents received on behalf of its FMCSA subscribers. As a subscriber, Evilsizor agrees to accept transportation-related legal documents only, as prescribed under 49 Code of Federal Regulations Part 366, and to forward those documents to you in a timely manner via email, fax, and/or mail. All summonses, court documents, and DOT correspondence received on your behalf are forwarded via USPS Priority Mail (with tracking and, when applicable, signature confirmation) to the address listed in the FMCSA/USDOT system. It is the subscriber’s responsibility to ensure that all contact information on file with the FMCSA/USDOT system — including mailing address, physical address, email address, and phone number — is accurate and up to date.
Evilsizor Process Servers, Inc. does not accept divorce papers or personal court documents unrelated to the interstate transportation industry.
Returned Mail and Address Responsibility
Legal documents are forwarded to the address on file at the time of receipt. If mail is returned as unclaimed, undeliverable, or due to an invalid address, the returned mail will be retained for recordkeeping purposes.
Evilsizor Process Servers, Inc. is not responsible for delays, non-delivery, or consequences arising from inaccurate, outdated, or unattended mailing addresses. Additional mailings will not be made unless the subscriber provides an updated address in writing or agrees to additional mailing costs.
Forwarding of documents by email, when available, is provided as a courtesy and does not generally replace mailed delivery. In certain cases, where proof exists that the client has also received a copy by mail from another source, email may serve as the primary method of notice.
Scope of Services
Evilsizor Process Servers, Inc. accepts Service of Process only in its role as a BOC-3 process agent. Evilsizor has designated agents in all 50 states and Washington, DC for this limited purpose. Clients are not authorized to use Evilsizor’s designated agents for any purpose beyond BOC-3 services. Evilsizor’s agents may not be designated as corporate registered agents with any Secretary of State.
Evilsizor does not assist motor carriers or transportation companies with registered agent services or any services beyond the scope of BOC-3 filings and process agent duties.
Service Fee and Payment Terms
All fees for filings submitted through Evilsizor, including BOC-3 filings, UCR filings, MCS-150s, 2290s, and related filings, are charged at the time of order. If payment is not received or the payment method is declined, the requested filing may not be processed or may be removed immediately. Initiating a credit card dispute may result in removal of filings, which could lead to inactivation of your FMCSA authority.
Invoices for service of process are due within thirty (30) days of the invoice date. If payment is not received by day thirty-one (31), Evilsizor may suspend or terminate service of process services, including the acceptance or forwarding of any legal documents on your behalf. Nonpayment may also result in the suspension of other services until the outstanding balance is paid in full.
If an invoice remains unpaid, Evilsizor Process Servers, Inc. reserves the right, at its discretion, to pursue collection of the outstanding balance through lawful means, including referral to a third-party collections agency.
Filing Policies
All BOC-3 filings are final. A new BOC-3 filing is required for new applications, address changes, reinstatements, name changes, or transfers of authority.
Refund Policy & Cancellation
All BOC-3 sales are final.
A BOC-3 order may be canceled prior to payment processing. Once payment has been processed and confirmation of filing has been emailed, the purchaser is responsible for payment and no refunds will be issued.
Chargebacks
Customers agree not to initiate chargebacks prior to contacting Evilsizor Process Servers, Inc. to attempt resolution of any dispute.
Unauthorized chargebacks may result in the customer being responsible for reimbursement of all fees incurred during the dispute process. Evilsizor reserves the right to pursue legal action to recover amounts owed.
Approved chargebacks will be credited to the original payment method. Processing may take up to 10 business days.
Agent-Filed BOC-3 Dispute Policy
If an agent files a BOC-3 on behalf of a client and the client disputes the charge, the filing agent will be responsible for a $99 fee to cover filing and dispute-related costs. The BOC-3 will be removed immediately.
Once the invoice is paid, the BOC-3 will be promptly refiled.
Indemnification
You agree to indemnify, defend, and hold harmless Evilsizor Process Servers Inc., its affiliates, successors, partners, officers, directors, employees, agents, licensors, suppliers, and any third-party service providers from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, to the maximum extent permitted by law, arising from any violation of this Agreement or the use of Evilsizor’s services by you or any other person accessing the service. You also agree to cooperate fully in the defense of any such claim or action.
We do not provide any legal advice. You will need to seek appropriate legal representation on your own, if applicable.
Termination of Service
Evilsizor Process Servers, Inc. reserves the right to cancel services and remove a BOC-3 filing under the following circumstances:
- Disputed or reversed credit card charges
- Non-payment of service invoices
- Unusual or extraordinary circumstances at Evilsizor’s discretion
